Kahnawà:ke Residency Law Notice

Written by on 11 June 2020

The Mohawk Council of Kahnawà:ke has issued a residency notice to the community. It relates to the impending finalization of the Kahnawà:ke Residency Law Regulations and actions. Kahsennenhawe Sky-Deer is the MCK Membership portfolio Chief:

“We didn’t have an enforcement mechanism when it comes to residency and because we now have a separate law, the regulations are being developed, there’s a complaints mechanism within there and if found guilty of an offence, like if individuals don’t meet the criteria to be here, they can be evicted, legally. We’re at a place in our history where we didn’t ever have this, so this is the direction we got from the community in terms of our law.”

Community members will soon be able to officially file complaints on those who are suspected of being in contravention of the Residency Law.

Chief Sky-Deer:

“If there are individuals who the community is looking at as being questionable, like should they be residing here, once a complaints officer is hired, which is in the process, then investigations will commence and then there could be legal proceedings because all residency files will be heard under the Court of Kahnawà:ke.”

For more information on the law, you can access the full document Kanien’kehá:ka of Kahnawà:ke Law. There is a section called “REVOCATION OF ENTITLEMENTS” and under section 13 “RESPONSIBILITIES.”
